Land & Environment Court Appeal

A development application and Environmental Impact Statement for State Significant, Designated and Integrated Development was lodged for the Careel Bay Marina Development with the Department of Planning on 10 June 2005 being Development Application No. DA 1004/6/2005.

The Development Application was subsequently refused by the Minister for Planning on 14 February 2006.

Land and Environment Court of NSW proceedings No. 170076 of 2007 were commenced by Austral Monsoon Industries on 2 February 2007 appealing against the Minister’s decision to refuse the Development Application.

Austral Monsoon Industries has obtained the leave of the Court on 4 May 2007 to rely on amended plans and other changes to the development application.  A range of further reports by specialist consultants have also been undertaken as part of the preparation of the amended development application.

The purpose of the amended plans and consultant’s reports was to address the environmental impacts of the amended scheme and to specifically address the Minister’s reasons for refusal.

Orders of the Land and Environment Court of New South Wales made on 4 May 2007 require the amended development application and the accompanying reports be placed on public exhibition and notified in accordance with the Environmental Planning and Assessment Act 1979 and the Environmental Planning and Assessment Regulation 2000.


Exhibition
The amended plans and support documentation will be on exhibition from Friday 18 May 2007 to Monday 18 June 2007, during regular business hours, at the following locations:

  • Department of Planning

    23-33 Bridge Street,
    Sydney

  • Pittwater Council
    1 Park Street,
    Mona Vale


Written Submissions
You are invited to make a written submission on the amended plans. This submission should include:
  • Your name and address;
  • The DA number (DA-144-6-2005-i);
  • A statement on whether you support or object to the proposal; and
  • The reasons why you support or object to the proposal.
